As an adult participant, or as the legal guardian of my designated participant(s) I hereby consent to all participants(s) participating in Physique Swimming programs.

Payments & Billing:
By agreeing to these terms and conditions, you acknowledge and agree to adhere to all Physique Swimming payment and billing policies. Physique Swimming reserves the sole right to process charges for unpaid balances when applicable.

Refund Policy: Once a purchase has been completed, refunds, credits, or transfers will not be issued for any reason. All sales are final at the time of purchase, including but not limited to:
• Membership / Season Pass Fees
• Guest Pass Fees
• Class or Camp Tuition

Participants are responsible for ensuring that their selected programs and schedules are appropriate before completing registration.

Inclement Weather: As an outdoor facility, pool operations are subject to weather conditions. Programs, events, and operating hours may be delayed, shortened, modified, or canceled due to lightning, heavy rain, high winds, or other conditions deemed unsafe by management.
Temporary suspension of pool operations due to weather does not constitute grounds for refunds, credits, or reimbursement.

Closures & Operational Changes: Physique Swimming reserves the right to cancel programs, modify schedules, adjust operating hours, or temporarily close the facility due to inclement weather, safety concerns, emergencies, facility maintenance, or other operational needs.
Such changes may occur with little or no advance notice. Refunds, credits, or adjustments will not be issued for schedule changes, interruptions, or temporary closures.

Operational Conditions: Participation and facility access are subject to operational, safety, and environmental conditions as determined by Physique Swimming management.

Release of Liability:
By agreeing to these terms, I acknowledge that swimming and participation in aquatic activities involve inherent risks, including but not limited to injury, serious harm, or death.
As an adult participant, or as the legal guardian of a minor participant, I voluntarily consent to participation in Physique Swimming programs and assume all risks associated with such participation.
I agree to release, indemnify, and hold harmless Physique Swimming and Riverdale Neighborhood House, its employees, instructors, staff, and affiliated entities from any claims, liabilities, damages, losses, or expenses arising out of or related to participation in Physique Swimming programs or use of its facilities.
I confirm that I have the legal authority to agree to these terms on behalf of myself and any participant(s) associated with my account.

Media Release:
By agreeing to these terms and conditions, you grant Physique Swimming permission to photograph, film, or record participants, parents, guardians, and accompanying individuals while participating in Physique Swimming programs or activities.
These materials may be used for advertising, promotional, educational, or training purposes without compensation.
By agreeing to these terms, you waive any rights to compensation or claims related to such use, including rights under New York Civil Rights Law §50 and §51, or similar laws.

Information Storage & Communications:
By agreeing to these terms and conditions, you consent to Physique Swimming collecting and securely storing your contact information, including name, phone number, email address, and postal code.
This information may be used for operational communications, program updates, marketing, and promotional purposes related to Physique Swimming services.
Physique Swimming may also collect and store demographic information such as age, gender, and postal code for internal research and program development.
Personal information will never be sold or shared with outside third parties.
By agreeing to these terms, you consent to receiving communications from Physique Swimming via phone (call or text) and email regarding services, programs, updates, and promotional information.
